Full ownership rights are not sold or granted; clients only receive limited use licenses unless directly stated otherwise for custom/commercial projects. Photo Rights and Usage for Real Estate Media: The original agent/client who paid for the service has permission to use the images on any electronic or printed form of advertisement for the promotion of that property. The licensing agreement is valid only for the duration the home/property is listed for sale and cannot be reused without specific written permission from Zack Hayes Media LLC. Zack Hayes Media LLC must be made aware, credited, and compensated for any printed or digital publication/use where photos are not being used for the direct marketing of the sale of the property.
Agents/clients may not sell, transfer, or gift any images for any reason to any third party, especially to another agent who takes over an expired, withdrawn, or cancelled listing. These third parties also include sellers, builders, stagers, and any other contractors associated with the property or agent. Media licenses are non-transferable.
Zack Hayes Media LLC reserves the right to re-license the photos.
Failure to pay for the images will result in a copyright infringement/violation. You will be asked to remove the image from any electronic or printed form of advertisement within 24 hours. Failure to stop using them will result in legal action.
Once photos have been delivered, the agent/client may not make any digital alterations, editing, or "photoshopping" to the photos. If there is an issue or concern with editing or photos please contact Zack Hayes Media LLC, but do not make alterations as this is a violation of copyright.
Expectations of Agent/Owner: Agents and homeowners are expected to have the property cleaned and/or staged prior to the photo shoot. The property should be secure with no hazards to the photographer’s safety, including snow removed from walkways and decks during winter. If the property is not ready to be photographed, agent/client should make every effort to reschedule at least 24 hours prior to the shoot. Zack Hayes Media LLC is not responsible for staging, cleaning, decluttering, or landscaping.
Cancellation and Rescheduling Policy: By scheduling and confirming service agent/client affirm that the property is ready for photos to be taken. Any cancellation/rescheduling once the photographer has arrived will be subject to 100% of the package amount. This includes, but is not limited to: property not ready, staging incomplete, construction, agent/owner not home, no key in lockbox, etc..
Weather Policy: Zack Hayes Media LLC will photograph in all weather. However, the weather should be evaluated several days prior to the shoot to prevent any need for rescheduling. In the event of adverse (snow storms, severe road conditions, heavy rain or wind) weather, the agent/client will be given the option to reschedule at no additional charge. This is at the discretion of Zack Hayes Media LLC, and dependent on availability.
Drone/Aerial Policy: Drones are subject to the rules of the FAA and weather. Zack Hayes Media LLC is a licensed and compliant part 107 drone operator and will acquire any necessary airspace authorization for your property. In some cases, this can take time to clear through the FAA, and some areas are off limits. Severe weather, including rain and snow cannot be flown in nor does it produce anything near the level of quality that is expected. In the event of bad weather, drone shoots will be rescheduled at no addition charge.
Rush Policy: A minimum of 72 hours notice is recommended when scheduling for a property shoot. A request for photos to be completed and delivered same day of shoot is subject to a $50 rush fee.
Media Guarantee: Zack Hayes Media LLC will make every effort to ensure the final images/videos/scans are of high quality and represent the property in the best way. Sometimes however, an agent/client/homeowner may feel these media do not meet those expectations. In this case, Zack Hayes Media LLC will work closely with the agent/client/homeowner to correct the issue and media. A reasonable amount of re-editing will be performed at no additional cost. If a return trip is requested due to issues in the media regarding decluttering, additional media not specifically requested prior to shoot, or other aspects that are not directly the responsibility of Zack Hayes Media LLC, there will be a return trip charge. Everyone has a different idea of their "best photo" but prior to hiring Zack Hayes Media, please carefully review the portfolio as there will be no refunds issued to clients who are not happy with the "style" of photography. “Style” refers to image angles, color, and any other visual aspect of the images/videos/scans.
Delivery of Photos: For most standard real estate shoots, Zack Hayes Media LLC guarantees a next day turn around time. Some photo shoots of larger properties or with extensive editing/special requests, such as the maximum exposure package, twilight, and aerial videography may take up to 48 hours.
Travel Surcharge: Properties outside of the Anchorage/Eagle River/Chugiak area are subject to a minimum travel fee of $25 depending on distance. A larger travel surcharge will be assessed for properties significantly out of range.
Right to Refuse: Zack Hayes Media LLC reserves the right in its sole discretion to refuse service at any time for any reason. At any time, Zack Hayes Media LLC can terminate the relationship with or fire a client for overdue invoices, poor communication, or unreasonable requests.
By visiting or using any website owned by Zack Hayes Media LLC, or by hiring to provide photographic services, you are agreeing to be bound by these terms and conditions. You are also acknowledging that such agreement constitutes a binding contract between you and Zack Hayes Media LLC.
